An Act

To assure safe and healthful working conditions for working men and women; by authorizing enforcement of the standards developed under the Act; by assisting and encouraging the States in their efforts to assure safe and healthful working conditions; by providing for research, information, education, and training in the field of occupational safety and health; and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the "Occupational Safety and Health Act of 1970."

SEC. 5. Duties
(a) Each employer --

(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

(2) shall comply with occupational safety and health standards promulgated under this Act.

(b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.

SEC. 17. Penalties (a) Any employer who willfully or repeatedly violates the requirements of section 5 of this Act, any standard, rule, or order promulgated pursuant to section 6 of this Act, or regulations prescribed pursuant to this Act, maybe assessed a civil penalty of not more than $70,000 for each violation, but not less than $5,000 for each willful violation.

106.8. Flammable liquid means any liquid having a flash point below 100F (37.8C) or higher, the total of which make up 99 percent or more of the total volume of the mixture. Flammable liquids shall be known as Class I liquids. Class I liquids are divided into three classes as follows:

Class IA shall include liquids having flash points below 73F (22.8C) and having a boiling point below 100F o(37.8C).

Class IB shall include liquids having flash points below 73F (22.8C) and having a boiling point at or above 100F o(37.8C).

Class IC shall include liquids having flash points at or above 73F (22.8C) and below 100F (37.8C).

It should be mentioned that flash point was selected as the basis for classification of flammable and combustible liquids because it is directly related to a liquid's ability to generate vapor, i.e., its volatility. Since it is the vapor of the liquid, not the liquid itself, that burns, vapor generation becomes the primary factor in determining the fire hazard. The expression "low flash - high hazard" applies. Liquids having flash points below ambient storage temperatures generally display a rapid rate of flame spread over the surface of the liquid, since it is not necessary for the heat of the fire to expend its energy in heating the liquid to generate more vapor.

  • 18 GAUGE DOUBLE WALL CONSTRUCTION & SEAMED JOINTS

    Securall Safety Cabinets have Structurally Reinforced 18-Gauge Double Wall All Welded Construction throughout.

  • 1910.106(d)(3)(ii)(a). The bottom, top, door, and sides of cabinet shall be at least No. 18-gauge sheet iron and double walled . . . Joints shall be riveted, welded or made tight by some equally effective means

  • 6.3.3.2.a. The bottom, top, door, and sides of the cabinet shall be at least No. 18 gauge sheet steel
    6.3.3.2.b. Joints shall be riveted, welded, or made tight by some equally effective means.

  • 3.2.1. Cabinets shall be of double wall steel or single wall wood construction. Steel thickness shall not be less than 18-gauge Seams and joints shall be secured by riveting, welding, brazing, or some equally effective means.

  • DOUBLE WALL CONSTRUCTION WITH 1 ½” AIR SPACE

    Securall cabinets have Double Wall Construction with 1 ½" Air Space throughout the cabinet design.

  • 1910.106(d)(3)(ii)(a). Metal cabinets constructed in the following manner shall be deemed to be in compliance. The bottom, top, door, and sides of cabinet shall be . . .double walled with 1 1/2 - inch air space.

  • 6.3.3.2.a. The bottom, top, door, and sides of the cabinet . . . shall be double-walled, with 38 mm (1 ½ in.) air space.

  • 3.2.1.A. Cabinets shall be of double wall steel. . .Walls, top, and door(s) shall have a gap of not less than 1 1/2 in. (38 mm) between the inner and outer panels. . . Nonflammable insulation may be placed within the gap.

  • 2" DEEP LEAK PROOF SILL

    Securall cabinets are built with an OSHA compliant leak proof sill 2" Deep to prevent leakage in the event of accidental spills.

  • 1910.106(d)(3)(ii)(a) . . .The door sill shall be raised at least 2 inches above the bottom of the cabinet.

  • 6.3.3.2.c. The doorsill shall be raised at least 50 mm (2 in.) above the bottom of the cabinet to retain spilled liquid within the cabinet.

  • 3.2.1.C. Cabinets shall be equipped with a leak-tight spill containment sump or pan not less than 2 in. (51 mm) deep.

  • NON-SPARKING , 3-POINT, SELF-LATCHING DOORS

    Each Securall cabinet is outfitted with FM required Non-Sparking, 3-Point, Self-Latching door(s) for safe and complete closure every time.

  • 1910.106(d)(3)(ii)(a) The door shall be provided with a three-point lock

  • 6.3.3.2.c. The door shall be provided with a three-point latch arrangement.

  • 3.2.1.B. Door(s) of the cabinet shall be equipped with a lockable, non-sparking, three-point latching mechanism.

  • SELF-CLOSING MECHANISM (IF INSTALLED) SEGREGATED FROM HAZARD AREA

  • 106(e)(6)(i) "General." Adequate precautions shall be taken to prevent the ignition of flammable vapors. Sources of ignition include but are not limited to open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks;

  • FUSIBLE LINK ASSEMBLY ON SELF-CLOSING MODELS

    Self-Closing cabinets come with Fusible Link Assembly. Link melts at 165 F for automatic closure in case of fire. Self closing mechanism segregated from hazard area..

  • 3.2.1.F. . . . If a means for holding the door(s) open is provided, this device shall automatically release the doors in the event of a fire or exposure to excessive heat. The device shall release the closing mechanism when exposed to a temperature of 212°F (100°C) or less.

  • STATIC GROUNDING CONNECTION

    All Securall cabinets come ready with an FM defined static ground connection, comprised of a NFPA compliant 5/16 - 18 x ½” Zinc Plated Grounding Bolt.

  • 307(c)(3). Safe for the hazardous (classified) location . . . Note: The National Electrical Code, NFPA 70, contains guidelines for determining the type and design of equipment and installations which will meet this requirement. The guidelines of this document address electric wiring, equipment, and systems installed in hazardous (classified) locations and contain specific provisions for the following: (including). . Grounding.

  • ARTICLE 250.8. Grounding conductors and bonding jumpers shall be connected by exothermic welding, listed pressure connectors, listed clamps, or other listed means. . . Sheet metal screws shall not be used to connect grounding conductors or connection devices to enclosures.

  • 3.2.1.E. A means shall be provided for attaching a separate grounding wire to the exterior of the cabinet. The attachment means shall be such that the cabinet finish does not interfere with the establishment of a proper ground.

  • LARGE WARNING LABEL

    Securall cabinets have a Large Warning Label to identify the type of material stored within the unit. Also available in French and Spanish.

  • 1910.106(d)(3)(ii). Cabinets shall be labeled in conspicuous lettering, "Flammable - Keep Fire Away.”

  • 3.3.1. Cabinets shall, as a minimum, be labeled with the manufacturer’s name, address, model number, and maximum liquid storage capacity. 3.3.2. All Approved cabinets shall be labeled with an FM Approval Mark 3.3.3. Cabinets shall be labeled with the conspicuous legend: FLAMMABLES – KEEP FIRE AWAY. 3.3.4. All markings shall be legible and durable.

  • ADJUSTABLE LEVELING LEGS

    Securall cabinets are equipped with four adjustable Zinc Plated Leveling Legs for placement on uneven surface areas.

  • 3.4. The manufacturer shall provide instructions pertaining to proper leveling of the cabinet

  • FLUSH MOUNTED LOCKING HANDLE

    All Securall safety cabinets come standard with a Flush Mounted Locking Handle for smooth finger-tip operation.
